Key East Entertainment lodged a complaint against the decision by the Ministry of the Gender Equality & Family to ban the singer’s song after MOGEF cited that the lyrics referring to alcohol and cigarette are harmful to the youth.
The court stated, “References to drinking and smoking as a means to alleviate sad feelings are often found in films, literature and dramas allowed for youngsters.”
The court continued, “Drinking and smoking can be referred in pop music to effectively convey meaning, and such expressions should be allowed to safeguard the freedom of creation.”
“The lines of the song like ‘I’m drunk and I cried,’ and ‘Amidst the spread of cigarette smoke’ are used to express heartbreaking emotion after breakup, not to encourage drinking or smoking,” the judge added.
The Seoul Administrative Court also ruled in favor of SM Entertainment and Cube Entertainment in a series of lawsuits filed by the firms, demanding the withdrawal of ban on their singers’ songs placed by the Ministry of the Gender Equality & Family.
